The article is dedicated to the comparative characteristic of the notion of necessary defence in the criminal legislation of the Russian Federation and France. The author examines the application of the legislation on the defense in the explanations of the Plenum of the Supreme court of the Russian Federation, and also the historical aspect of the creation and formation of the Institute of necessary defence in France, thus drawing a parallel criminal legislation of the two countries on the issue of harm attacker, while protecting the identities and rights of the defender or other person legally protected interests of society or the state from socially dangerous encroachments.
