INFLUENCE OF CIVIL CAPACITY ON LABOR RIGHT SUBJECTIVITY OF THE EMPLOYER WHO IS THE NATURAL PERSON

One of the parties of labor legal relationship is the employer. The labor code of the Russian Federation defines that the natural or legal entity can act as the employer. The majority of employers - legal entities. Natural persons are employers if they are engaged in business activity without formation of legal entity or enter the labor relations with other persons for personal service and assistance on housekeeping. Features of legal status of the employer are fixed in Art. 22 of the Labour code of the Russian Federation. However essential influence on the volume of the rights and duties is rendered also by civil capacity. Thus civil capacity the age and a mental maturity of the citizen are assumed as a basis. In this publication attempts on detection of legal features of influence of civil capacity on legal status of the employer who is the natural person are made.
