The article reviews historico-legal aspects of regulation of responsibility for the organization of criminal communities, the participation in criminal communities illegal activity of the communities in XIX–XX centuries. The author comes to the conclusion that the Criminal Code of 1903 provided severe punishment for the activity of criminal commu nities : capitel punishment, hard labour , deportation what prove the significance that Russian lawmaker paid to the struggle against the organized criminals.
