The article investigates the essential characteristics of the concept of differentiation and forms of abuse of dominant position in the Russian legal regulation of contractual relations and European integration law. The conclusion is that a contract can act as a legitimate tool of abuse of dominant position by an economic entity . Based on a comparative study of national legislation and EU law unified doctrinal approaches and jurisprudence reveals independent criteria and aggravating circumstances of abuse of dominance . Identified the most common practices of the dominant subjects form a restriction of competition . Marked the principles of civil law have been violated by the contract as a means of abuse.
